Terminating the contract for legal services
You may terminate the contract for legal services at any time, even without giving a reason. The advocate may also terminate the contract, under the conditions laid down in the Legal Profession Act (Section 20 of the Legal Profession Act). Termination does not affect your obligation to pay the fee and any other costs for legal services actually provided. Termination takes effect when the notice is delivered.
Unless we agree otherwise or you make other arrangements, we are obliged for 15 days to take urgent steps necessary to protect your rights and legitimate interests; this obligation does not apply if you tell us that you do not insist on it.
Rights arising from defective performance
If a legal service has been provided defectively, you have the right to demand a remedy appropriate to the nature of the defect, in particular proper provision of the service or, where applicable, a reasonable reduction of the fee, provided the statutory conditions are met.
You can exercise your rights arising from defective performance with the advocate concerned. In your claim, state which legal service was provided, what you consider its defect to be and what remedy you request. Under the Consumer Protection Act, we must settle the claim within 30 days of the day it was made at the latest, unless we agree on a longer period.
Out-of-court settlement of consumer disputes
If a dispute arises between us from the contract for legal services and cannot be resolved by agreement, you may apply for its out-of-court settlement to the Czech Bar Association, which is competent under Section 20e of the Consumer Protection Act. Details and the procedure are available at www.cak.cz.
The consumer may file the application to initiate out-of-court proceedings no later than 1 year from the day on which they first asserted the right that is the subject of the dispute with the advocate.
Price of services
The price of our services is agreed in advance in the contract, either as a contractual fee or under the lawyers’ tariff (Decree No. 177/1996 Coll.). Indicative prices are listed in our fees.
Professional liability insurance
The advocates are insured by law against liability for damage caused in connection with practising law (Section 24c of the Legal Profession Act).
Complaints
You can send a complaint about the service by e-mail to the advocate who provides it; we will deal with it without undue delay. You can also lodge a complaint about an advocate’s conduct with the Czech Bar Association (www.cak.cz).
